Every employee must have a fixed and clearly defined seven-day workweek.
Sometimes employers get confused between a workweek and a pay period. The IRS is pretty clear on the topic: Every employee must have a fixed, seven-day workweek.
It doesn’t matter if it’s Sunday to Saturday, Wednesday to Tuesday, or some other configuration. It doesn’t matter if you pay your employees weekly, biweekly, or monthly – that’s a pay period.
A workweek is a consecutive seven0day, 169-hour timeframe. And it must be the same every week. – you can’t change the parameters of the workweek randomly.
And remember: You must pay overtime to non-exempt employees for any hours over 40 in theĀ workweek.
